Following reports that Nintendo has taken action against fan-created content from Rhythm Heaven as well as a recent emulator, it now seems we have new developments regarding these illegal activities. These come after learning that Nintendo has updated its privacy policy for the Switch 2, stating that the audio and video of GameChat could be recorded.

After multiple failed notification attempts and Nintendo’s request for a default judgment, both parties reached an agreement on September 5, 2025. The streamer will pay 2 million dollars to Nintendo and, additionally, will be prohibited from possessing, distributing, or using modchips, flashcarts, and any related devices that bypass security measures.
Nintendo will also seize all illegal items in his possession, along with the final closure of his website. Another example of the company’s fight against piracy.
