It’s no secret: everyone knows that Nintendo heavily protects Nintendo Switch games. Today we receive interesting statements sobre las políticas protectoras de Nintendo.

After learning that Nintendo has taken measures against fan-created content from Rhythm Heaven as well as another emulator recently, it now seems that there are new actions against these illegal procedures. These come after learning that Nintendo has updated its privacy policy for the Switch 2, indicating that the audio and video of GameChat could be recorded.

Aside from this measure, another adjustment was found regarding collective lawsuits against the company in the user agreement to avoid collective lawsuits. But it seems there’s more: Nintendo has updated the Nintendo Account Agreement, which is necessary to use the eShop and play downloadable titles.

The new agreement specifically targets users who modify their Switch or play pirated copies and now explicitly states this:

  • Nintendo now explicitly details what it considers illegal or unauthorized uses and warns that it reserves the right to make a Switch console «permanently inoperable» if these rules are violated.
  • It is prohibited, among other things:
    • (a) Publishing, copying, modifying, reverse engineering, renting, leasing, decompiling, disassembling, distributing, selling, or offering derivative works of any part of the Nintendo Account Services.
    • (b) Bypassing, modifying, decrypting, altering, or manipulating functions or protections of the Nintendo Account Services, including the use of hardware or software to operate in an unauthorized manner.
    • (c) Obtaining, installing, or using unauthorized copies of the Nintendo Account Services.
    • (d) Exploiting the Nintendo Account Services in any way not permitted by the official documentation and its intended use, without written consent from Nintendo or unless permitted by law.
  • If these restrictions are not met, Nintendo may disable the Nintendo Account Services and/or the affected device partially or entirely.
  • This measure is part of a broader offensive by Nintendo against piracy, which has included lawsuits and actions against pirate software distributors and emulators.
